These Terms of Use ("Terms") govern your access to and use of www.theeaglenexus.com and any related pages or services (the "Site") operated by Eagle Nexus Real Estate Group ("Eagle Nexus," "we," "us," or "our"). Real estate brokerage services are provided by our sponsoring broker, LPT Realty, LLC, TREC License #9012763-BB, 13315 Wallaceville Road, Houston, Texas 77049. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Not an offer or professional advice

Information on the Site is provided for general informational purposes only and does not constitute an offer, solicitation, or agency relationship. Home valuations, cash-offer estimates, market statistics, mortgage calculators, and similar tools are estimates, not appraisals, guarantees, or commitments to lend. Consult a licensed real estate, legal, tax, or financial professional for advice specific to your situation.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Site. If you create an account (for example, through our IDX search provider), you are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Scrape, spider, or bulk-download any content, including MLS/IDX listing data.
  • Use listing data for anything other than identifying prospective properties you may be interested in buying or leasing.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site.
  • Upload or transmit viruses, malware, or any code designed to harm the Site or other users.
  • Reverse engineer, decompile, or attempt to derive source code from the Site.
  • Submit false, misleading, or third-party contact information.

4. MLS/IDX and listing content

Listing content displayed on the Site is provided under license from the applicable multiple listing service, which may include the Houston Realtors Information Service, Inc. ("HAR"). IDX information is provided exclusively for consumers' personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing or leasing. Data is deemed reliable but is not guaranteed accurate by the MLS. You should independently verify all information before relying on it. Additional MLS terms and attributions apply and are shown with the relevant listing data.

5. Intellectual property

The Site and its content — including text, graphics, logos, images, and software — are owned by Eagle Nexus, its licensors, or its content providers and are protected by U.S. and international intellectual property laws. Eagle Nexus grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for its intended purpose. Any other use requires our prior written consent.

6. Third-party services and links

The Site may include or link to third-party services and content (for example, our IDX provider AeroIDX, our CRM/marketing platforms GoHighLevel and ListingLab, our analytics tool WidgetBe, mortgage calculators, and lender or title partners). We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

7. Communications consent

By submitting a form on the Site or otherwise contacting us, you consent to receive communications from Eagle Nexus and our agents at the email address, phone number, or other contact information you provide, including via automated systems and prerecorded or artificial voice messages where permitted. You can opt out of marketing emails via the unsubscribe link and opt out of SMS by replying STOP. Transactional messages related to a pending transaction may continue as necessary. 8. Fair Housing

Eagle Nexus complies with the Federal Fair Housing Act and all applicable state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other protected class.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. EAGLE NEXUS DOES NOT WARRANT THAT THE SITE OR ANY LISTING, VALUATION, ESTIMATE, OR OTHER CONTENT IS ACCURATE, COMPLETE, CURRENT, RELIABLE, UNINTERRUPTED, OR ERROR-FREE. YOU USE THE SITE AT YOUR OWN RISK.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EAGLE NEXUS, ITS SPONSORING BROKER, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Eagle Nexus, its sponsoring broker, agents, affiliates, and licensors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

Your notice must include the information required by 17 U.S.C. § 512(c)(3).

13. Governing law, venue, and dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

Agreement to arbitrate. Except for claims that qualify for small-claims court or claims seeking injunctive relief to protect intellectual property rights, you and Eagle Nexus agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small-claims court.

Class action waiver. YOU AND EAGLE NEXUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree, no arbitrator may consolidate more than one person's claims.

Venue for excluded claims. For any dispute not subject to arbitration or small-claims court, you and Eagle Nexus consent to the exclusive jurisdiction and venue of the state and federal courts located in Montgomery County, Texas.

14. Changes to the Site and Terms

We may modify or discontinue the Site (or any part of it) at any time. We may also update these Terms; changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

15. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections intended to survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.
